1. Introduction

Welcome to MedVibe Logistics (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our courier, delivery, and logistics services (the “Services”) and our website www.medvibelogistics.com to these Terms in full. If you do not agree, you must not use MedVibe Logistics’ Services or website.

2. Company Overview

MedVibe Logistics provides medical courier and general courier delivery services throughout Illinois, including same-day, rush, on-demand, routed, and specialized deliveries for medical, legal, freight, and other industries.

We operate from our headquarters in Joliet, Illinois and maintain compliance with all applicable federal, state, and local transportation, data privacy, and health regulations — including HIPAA (for medical deliveries).

3. Eligibility

By using our Services, you represent that you:

• Are at least 18 years of age or the legal age of majority in your jurisdiction;

• Have the authority to enter into a binding contract; and

• Will use the Services only for lawful purposes and in compliance with these Terms.

4. Services Provided

MedVibe Logistics offers a range of delivery and courier solutions, including but not limited to:

• Medical courier services (specimen transport, pharmaceuticals, medical devices)

• Legal document and courthouse filing deliveries

• Freight and large-item transport

• Same-day, rush, and scheduled delivery options

• On-demand and multi-destination routes

We reserve the right to modify or discontinue any Service at our discretion, with or without prior notice.

5. Orders and Scheduling

• Orders for pickup or delivery can be placed through our website, phone, or authorized partner platforms.

• You are responsible for providing accurate and complete details (pickup address, contact information, contents, and delivery instructions).

• Incorrect or incomplete information may cause delays or cancellation of service, for which we are not liable.

• Once confirmed, scheduled orders may be subject to cancellation or rescheduling policies described in Section 9.

6. Rates and Payments

• Delivery fees are calculated based on distance, weight, item size, urgency, and service type.

• Additional fees may apply for waiting time, after-hours service, special handling, or excessive mileage.

• All charges are due at the time of booking unless otherwise agreed in writing.

• Accepted payment methods include major credit cards, ACH transfer, or invoiced billing for approved clients.

• Past-due accounts may be subject to late fees and suspension of service.

7. Delivery Conditions

• We make every reasonable effort to ensure on-time delivery; however, delays may occur due to weather, traffic, emergencies, or other factors beyond our control.

• Delivery times are estimates, not guarantees, unless explicitly stated in writing.

• Deliveries requiring a signature or proof of delivery will not be considered complete until such confirmation is received.

• MedVibe Logistics reserves the right to refuse or cancel deliveries deemed unsafe, unlawful, or not properly packaged.

8. Medical Courier Compliance

When performing medical courier services, MedVibe Logistics operates as a HIPAA-compliant Business Associate.
We ensure:

• Chain of custody integrity for all medical materials,

• Secure handling and temperature control where required,

• Trained personnel for specimen and PHI transport, and

• Immediate reporting of any incident affecting confidentiality or delivery integrity.

Clients must ensure that items requiring special compliance (e.g., biohazard labeling, temperature monitoring) are properly identified and packaged prior to pickup.

9. Cancellations and Refunds

• Cancellations made before dispatch may be refunded in full.

• Cancellations after dispatch may be subject to a cancellation fee or partial refund, depending on distance traveled and resources used.

• No refunds will be issued for completed deliveries or delays outside of our control (e.g., weather or recipient unavailability).

• Refunds, if applicable, will be processed to the original payment method within 7–10 business days.

10. Liability and Limitations

• MedVibe Logistics’ maximum liability for loss, damage, or delay is limited to the declared value of the shipment or $100 per package, whichever is less, unless otherwise stated in a written agreement.

• We are not liable for consequential, incidental, or indirect damages arising from delays, loss, or misuse of delivered items.

• Clients must report any claims for loss or damage within 5 business days of delivery.

• We do not transport illegal, hazardous, or restricted materials, including firearms, explosives, or narcotics.

11. Insurance

Customers are encouraged to purchase additional shipment insurance for high-value items. MedVibe Logistics provides standard coverage only as outlined above.

If you require extended coverage, please contact our office before scheduling.

12. Confidentiality & Data Protection

MedVibe Logistics values privacy and complies with all applicable privacy laws.
All data collected or processed during courier operations — including client information, delivery details, and PHI — will be handled in accordance with our Privacy Policy available at [Insert Privacy Policy Link].

13. Independent Contractors

Some drivers and delivery personnel may operate as independent contractors under agreements with MedVibe Logistics. These individuals are required to comply with all company policies, confidentiality obligations, and HIPAA standards.

14. Intellectual Property

All website content, including logos, text, graphics, and software, are the property of MedVibe Logistics or its licensors. You may not copy, reproduce, or distribute any materials without prior written consent.

15. Prohibited Uses

You agree not to use our Services to:

• Ship or transport illegal, stolen, or hazardous materials

• Harass, abuse, or endanger MedVibe Logistics staff or partners

• Interfere with system operations or misuse online booking tools

• Provide false information or misrepresent shipment contents

Violation of these terms may result in immediate suspension or termination of service.

16. Indemnification

You agree to indemnify, defend, and hold harmless MedVibe Logistics, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including attorney’s fees) arising out of your misuse of our Services or violation of these Terms.

17. Dispute Resolution

In the event of any dispute:

• Parties agree to first attempt resolution through good-faith negotiation.

• If unresolved, disputes shall be submitted to binding arbitration in Will County, Illinois, under the rules of the American Arbitration Association (AAA).

• The decision of the arbitrator will be final and binding.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

Any court action permitted under these Terms will be filed in the appropriate jurisdiction located in Will County, Illinois.

19. Changes to These Terms

We may update or modify these Terms periodically. All updates will be posted on our website with the revised effective date. Continued use of our Services after such updates constitutes acceptance of the revised Terms.
